Liability Waiver, Assumption of Risk, and Release

1. Owner's Representations

I certify that I am the legal owner of the dog identified in the consultation form or that I am authorized by the legal owner to enter into this Agreement.

I represent that I have truthfully disclosed all information known to me concerning my dog's health, temperament, behavioral concerns, aggression, bite history, reactivity, and previous incidents involving injury to a person or animal.

I agree to notify PAW School before any session if this information changes or if my dog develops symptoms of illness, injury, or contagious disease.

2. Inherent Risks

I understand that interacting with and training dogs involves inherent and unpredictable risks. These risks may include, but are not limited to:

• Bites, scratches, jumping, pulling, lunging, or other animal behavior;
• Injury to me, my dog, another person, or another animal;
• Falls, collisions, strained muscles, or other physical injuries;
• Escape, disappearance, illness, or death of a dog;
• Damage to clothing, equipment, vehicles, homes, or other property; and
• Incidents caused by unfamiliar surroundings, distractions, people, animals, equipment, weather, or environmental conditions.

I understand that a dog's behavior cannot be predicted or controlled with complete certainty, even when reasonable care and recognized training practices are used.

3. Assumption of Risk

I knowingly and voluntarily accept and assume all risks associated with participating in PAW School services, whether the risks are known or unknown, anticipated or unanticipated, inherent or otherwise.

I accept responsibility for supervising and controlling my dog unless PAW School expressly directs otherwise during a training exercise. I am also responsible for ensuring that my dog is properly secured with suitable equipment and is handled in accordance with PAW School's instructions.

4. Release of Liability

This Agreement does not release any claim that cannot legally be waived under applicable law.

5. Responsibility for the Dog

I accept responsibility for any injury, loss, or property damage caused by my dog while participating in or traveling to or from PAW School services.

I agree to follow all safety instructions provided by PAW School. I understand that PAW School may stop, postpone, modify, or refuse a service if PAW School believes that proceeding would create an unreasonable safety risk.

I agree not to bring any additional person, child, or animal to a session without advance permission. I accept responsibility for every person who attends with me and will ensure that minors remain under the direct supervision of a responsible adult.

6. Indemnification

To the fullest extent permitted by Texas law, I agree to defend, indemnify, and hold harmless PAW School and the other released parties from third-party claims, damages, losses, costs, or expenses arising from:

• My dog's actions or behavior;
• My failure to disclose relevant health or behavioral information;
• My failure to follow safety instructions;
• My negligence or misconduct; or
• The actions of another person attending with me.

7. Emergency Veterinary Care

If my dog experiences a medical emergency while under the immediate supervision of PAW School and I cannot be reached, I authorize PAW School to seek reasonable emergency veterinary care.

I understand that PAW School is not a veterinary provider and cannot diagnose or treat medical conditions. I accept financial responsibility for veterinary services obtained on my dog's behalf.

8. No Guarantee of Results

I understand that training outcomes depend on many factors, including the dog's temperament, health, environment, learning history, consistency, and the owner's participation.

PAW School does not guarantee that any specific behavior will be corrected, prevented, or permanently changed. I understand that continued practice and management may be necessary after training services have concluded.

9. Governing Law and Severability

This Agreement is governed by the laws of the State of Texas.

If any part of this Agreement is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law. This Agreement is intended to be interpreted as broadly as Texas law permits.

10. Electronic Acceptance

By entering my full legal name on the consultation form and selecting the required waiver-acceptance checkbox, I confirm that:

• I have carefully read this entire Agreement;
• I understand that it includes an assumption of risk and release of liability;
• I understand that it expressly addresses claims involving PAW School's ordinary negligence;
• I have had the opportunity to ask questions or seek independent legal advice;
• I am at least 18 years old and legally authorized to accept this Agreement; and
• I voluntarily agree to be legally bound by its terms.
